Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Dead Simple Email service, including the website at deadsimple.email, the API at api.deadsimple.email, and the dashboard at app.deadsimple.email (collectively, the "Service"), operated by Dead Simple Email ("we," "us," or "our").
By creating an account or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
1. Service Description
Dead Simple Email provides email infrastructure as a service, including:
- Programmatic email inbox creation and management via REST API
- Sending and receiving email messages through our infrastructure
- Real-time webhook notifications for incoming email events
- Email attachment storage and retrieval
- A web-based dashboard for account and inbox management
- Python SDK and client libraries for API integration
The Service is designed for developers and AI agents that need email capabilities integrated into their applications.
2. Account Registration
To use the Service, you must create an account. You agree to:
- Provide accurate and complete registration information
- Keep your account credentials secure and confidential
- Notify us immediately of any unauthorized access to your account
- Be responsible for all activity that occurs under your account
- Not share API keys or account credentials with unauthorized parties
- Use only one account per individual or organization (unless expressly authorized)
We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are fraudulent.
3. API Usage
Your use of the Dead Simple Email API is subject to the following terms:
- You must authenticate all API requests using a valid API key
- API keys are confidential and must not be embedded in client-side code, public repositories, or shared publicly
- You are responsible for all API calls made with your API keys
- We may modify the API with reasonable notice; breaking changes will be communicated in advance
- You must handle API errors and rate limit responses gracefully in your application
4. Acceptable Use Policy
You agree not to use the Service to:
4.1 Spam and Unsolicited Messages
- Send unsolicited bulk email (spam)
- Send messages to recipients who have not consented to receive them
- Send messages to purchased, rented, or harvested email lists
- Fail to honor unsubscribe requests within 10 business days
- Disguise the origin of email messages or use misleading subject lines
4.2 Phishing and Fraud
- Send phishing emails or messages designed to deceive recipients
- Impersonate any person, organization, or entity
- Collect credentials, financial information, or personal data through deception
- Engage in any form of email-based fraud or social engineering attacks
4.3 Malware and Harmful Content
- Distribute malware, viruses, ransomware, or other harmful software via email
- Send attachments designed to exploit vulnerabilities in recipients' systems
- Use the Service to facilitate cyberattacks or unauthorized access to third-party systems
4.4 Other Prohibited Uses
- Violate any applicable law, regulation, or third-party rights (including CAN-SPAM, GDPR, and CASL)
- Send content that is defamatory, obscene, or promotes illegal activity
- Interfere with or disrupt the Service or its infrastructure
- Attempt to circumvent rate limits, usage quotas, or security measures
- Reverse engineer, decompile, or attempt to extract source code from the Service
- Resell the Service without written authorization
We reserve the right to suspend or terminate your account immediately, without notice, if we determine that you have violated this Acceptable Use Policy. Repeated or egregious violations may result in permanent bans.
5. Rate Limits
The Service enforces rate limits to ensure fair usage and system stability. Rate limits vary by plan:
- Rate limits are applied per API key on a per-minute and per-day basis
- Exceeding rate limits will result in HTTP 429 (Too Many Requests) responses
- Rate limit headers are included in all API responses for your convenience
- We may adjust rate limits at any time; increases will be communicated in advance
- Deliberate or repeated attempts to circumvent rate limits may result in account suspension

6. Billing and Payments
6.1 Subscription Plans
The Service offers multiple subscription tiers with different feature sets and usage limits. Plan details and pricing are available on our pricing page.
6.2 Payment Terms
- Paid plans are billed monthly or annually in advance
- Payment is processed securely via Stripe using the payment method on file
- All fees are in US Dollars (USD) and are non-refundable unless otherwise stated
- You are responsible for any applicable taxes
6.3 Overages
If you exceed your plan's included usage limits (e.g., number of inboxes, emails sent), overage charges may apply as described on the pricing page. We will notify you when you approach your limits.
6.4 Plan Changes
- You may upgrade your plan at any time; upgrades take effect immediately with prorated billing
- You may downgrade your plan at the end of your current billing period
- Downgrading may reduce available features or limits; ensure your usage fits the new plan before downgrading
6.5 Failed Payments
If a payment fails, we will attempt to charge your payment method again over the following days. If payment remains unsuccessful, we may downgrade your account to the free tier or suspend access to paid features.
7. Data Ownership
- Your data: You retain all ownership rights to the data you submit to the Service, including email content, attachments, contact lists, and configuration settings. We do not claim ownership of your data.
- License to us: You grant us a limited, non-exclusive license to use, process, and store your data solely as necessary to provide and improve the Service.
- Data export: You may export your data at any time via the API or dashboard. Upon account termination, we will make your data available for export for 30 days before deletion.
- Aggregated data: We may use anonymized, aggregated data derived from your usage of the Service (e.g., delivery rate statistics) to improve the Service. Such data will not identify you or your recipients.
8. Intellectual Property
The Service, including its design, code, documentation, branding, and all related intellectual property, is owned by Dead Simple Email and protected by intellectual property laws. You may not:
- Copy, modify, or distribute any part of the Service without permission
- Use our trademarks, logos, or branding without written authorization
- Create derivative works based on the Service
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms for the duration of your subscription.
9. Termination
9.1 Termination by You
You may cancel your account at any time through the dashboard or by contacting us at hello@deadsimple.email. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.
9.2 Termination by Us
We may suspend or terminate your account:
- Immediately, for violation of the Acceptable Use Policy
- With 30 days' notice, for any other reason
- Immediately, if required by law or to protect the Service infrastructure
9.3 Effect of Termination
Upon termination, your right to use the Service ceases immediately. We will retain your data for 30 days to allow export, after which it will be permanently deleted (except as required by law). Provisions that by their nature should survive termination will survive, including Sections 7, 8, 10, 11, 12, and 13.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
- WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
- IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNTS YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
- WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, REGARDLESS OF THE CAUSE OF ACTION OR THEORY OF LIABILITY.
- WE ARE NOT LIABLE FOR DAMAGES ARISING FROM EMAIL DELIVERY FAILURES, DELAYS, OR MISROUTING BEYOND OUR REASONABLE CONTROL.
11. Indemnification
You agree to indemnify, defend, and hold harmless Dead Simple Email and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising from or related to:
- Your use of the Service
- Your violation of these Terms
- Your violation of any applicable law or third-party rights
- The content of emails sent through the Service using your account
- Any dispute between you and a third party related to emails sent or received via the Service
12. Governing Law and Dispute Resolution
12.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
12.2 Dispute Resolution
Any dispute arising from or relating to these Terms or the Service shall be resolved as follows:
- Informal resolution: Before filing any formal proceeding, you agree to contact us at hello@deadsimple.email and attempt to resolve the dispute informally for at least 30 days.
- Binding arbitration: If informal resolution fails, the dispute shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall be conducted in Delaware.
- Class action waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
12.3 Exceptions
Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.
13. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will:
- Update the "Last updated" date at the top of this page
- Notify you via email at least 30 days before the changes take effect
- Post the updated Terms on our website
Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service and cancel your account.
14. General Provisions
- Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Dead Simple Email regarding the Service.
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
- Waiver: Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
- Assignment: You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.
- Force majeure: We shall not be liable for any failure or delay in performance resulting from circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, or internet outages.
